USDA Clarifies Cannabis Food and Drinks Not Eligible For SNAP – MEDCAN24

Last week, the U.S. Department of Agriculture’s (USDA) Food and Nutrition Service Administrator sent an email to all USDA employees. Letter All Supplemental Food Assistance Program retailers are notified that cannabis-derived goods cannot be purchased with SNAP. James C. Miller, the Administrator of the Agency, said that this clarification forms part the commitment the agency has to combat “waste and fraud.”  

The letter reminds recipients that accepting SNAP benefits in exchange for food and beverages containing marijuana or cannabis is a violation of the program. — Miller, in the letter 

This letter also states that retailers who are in violation of the program will suffer consequences, including being disqualified from receiving SNAP payments, monetary sanctions, fines or criminal prosecution. 

This letter contains no information on what prompted the writing or how often cannabis-infused foods and beverages are bought with SNAP funds. 

On the USDA’s website, CBD is listed as an ineligible product, along with alcohol, beer, tobacco, vitamins and medicines, non-food products, hot foods at retail, animals that have been live, and other items.
