California Bill Would Let ‘Small’ Cannabis Producers Ship Directly to Consumers – MEDCAN24

California legislation would enable small cannabis producers in the state to directly sell and deliver their product to customers. The bill, the Small and Homestead Independent Producers (SHIP) Act, introduced by state Rep. Jared Huffman (D), would allow the state’s smallest cannabis farmers to mail cannabis products within the state or into other states where cannabis is legal, were the federal government to remove cannabis from the Controlled Substances Act.    

Larger, commercialized cannabis operations are infiltrating and pushing out local farmers. When the outdated federal prohibition of cannabis is finally repealed we will need a substantial piece of legislation to assist these small businesses in surviving. By ensuring that people can send their product directly to the consumer, I would help grow small businesses while also ensuring farmers remain afloat. We must not leave behind our family farmers, even when full legalization has been achieved. — Huffman in a press release   

A “small cannabis cultivator” is defined in the bill as a farm that grows “one-acre or less” of mature flowering Cannabis plant canopy outdoors, “22,000 or less” of cannabis canopy inside a greenhouse or “5,000 or fewer square feet” of mature floral cannabis plant canopies indoors. The proposal defines a “small manufacturer” as someone who manufactures a cannabis product, such as edibles or tinctures. 

In a statement, Ross Gordon, co-founder at National Craft Cannabis Coalition and Policy Analyst at Origins Council, said that “Nearly 15 years into the experiment of state-level cannabis legalization … small and craft producers are being pushed to the margins, safe access for consumers and patients is shrinking, and the industry is consolidating into the hands of a few.” 

Gordon stated that without direct-to consumer shipping, the federal legalization of cannabis risks reiterating these failures rather than correcting them. “The SHIP Act could be a game-changer for small cannabis companies in California and throughout the United States.” 

The California bill has received endorsements from the National Craft Cannabis Coalition, Minority Cannabis Business Association, National Cannabis Industry Association, Drug Policy Alliance, Parabola Center, Marijuana Justice, Veterans Cannabis Coalition, Origins Council, Washington Sun & Craft Growers Association, Vermont Growers Association, Maine Craft Cannabis Association, Humboldt County Growers Alliance, Mendocino Cannabis Alliance, Trinity County Agricultural Alliance, and the Central California Cannabis Club.
