WTTW reported that officials approved a change to the rule on Monday which will prevent officers from searching vehicles solely based on the smell.
CPD officials, despite some initial reservations, agreed to make the changes after advocates pursued them under the 2019 court order that required the department reform its policies. In a court filing on Monday, the American Civil Liberties Union of Illinois stated that they “applaud” the decision made by the Department last month.
This change is despite a ruling by the Illinois Supreme Court in 2024, which stated that police could search a car if they smelled raw cannabis during a stop. The same court had ruled three months prior that the smell from burnt marijuana was not enough to search a car without a warrant.
CPD reported conducting just 70 traffic stops based on suspected cannabis violations from December 2024 to June 2025 — the department, however, does not track how many traffic stops occur based on the smell of raw cannabis, according to the report.
Illinois allows adult use of cannabis. State law, however, requires the cannabis to be kept in “a sealed, odor proof, child resistant cannabis container” while being transported by vehicle.
