Florida’s campaign to ask voters to legalize cannabis in 2026 received enough signatures for a review by the state. Tallahassee Democrat reports. Smart & Safe Florida, the group behind the Failure 2024 effort, has submitted more than 337,000 signatures – surpassing the 220,000-signature threshold to prompt the legally-mandated financial and judicial review. Â
The State Attorney General James Uthmeier will now have to send the proposed ballot language proposal to the Supreme Court of California, who must ensure that the text is clear and single-subject. Â
This initiative would legalize cannabis in the United States for those adults over 21 years old. It also allows them to purchase cannabis, possess it, and consume cannabis non-medically. Marketing towards children and consumption by public is prohibited. On the ballot for 2024, there was no mention of any bans regarding marketing to children or use by public. Â
New state laws prohibiting non-residents from circulating petitions have created new obstacles for the campaign. On May 30, Smart & Safe Florida filed an emergency motion to a federal judge arguing that the law infringes on First Amendment rights and has “injured” the organization’s “number of people to carry their message to the public” and that the law is “very likely the difference between” the amendment getting on the ballot or not. Â
The amendment failed to garner 60% support in 2024. Â
