Democratic U.S. Reps. reintroduced Marijuana Opportunity Reinvestment and Expungement Act which will legalize cannabis on a federal level. The proposal – the fourth version introduced in Congress, would decriminalize cannabis at the federal level by removing the substance from the Controlled Substances Act (CSA), and would require federal courts to expunge prior cannabis convictions and to conduct re-sentencing hearings for those still under supervision. Â
The bill would allow for a 5 percent sales tax to be assessed on marijuana and cannabis-related products, creating an Opportunity Trust Fund with three grants programs. Small Business Administration funds would also become available to cannabis businesses and providers.Â
The measure would also provide non-discrimination protections for cannabis use or possession, and for prior convictions for a cannabis offense.Â
Rep. Dina Titus (D-NV), Co-Chairman of the Cannabis Caucus, said in a press release that “it’s time for us to update our laws so they reflect the realities of cannabis usage in the United States. We must also recognize and embrace the legitimate medical industry which has developed.” Â

The bill is sponsored by 40 Democratic legislators. Â
The first version of the legislation was introduced in 2019 and was approved by the House in 2020 but was never considered by the Senate. Another version of the legislation was passed by the House but, once again, it was never taken into consideration by the Senate. The third version, introduced in 2023 was not adopted by the Senate but referred to House Committees of Jurisdiction.Â
