More recently, the Illinois Legislature adjourned from its 2025 regular session in May without sending legislation on the matter to Pritzker’s desk, leaving intoxicating hemp-derived cannabinoids on the shelves of smoke shops, gas stations and convenience stores in what has become known as the unintended consequences of the 2018 Farm Bill, which federally legalized commercial hemp cultivation.
Pritzker stated, “We are now continuing our conversations with advocates of the hemp industry.” They need to know that children are becoming sick. Children are getting sick. It is possible for children to obtain this drug in a manner that they are not supposed to. Cannabis is regulated. “I am advocating for a hemp-regulated environment.”
Pritzker’s office brought attention to the issue of a FOX32 Chicago Reports cite more than 9,00 cases of Delta-8 THC poisoning in the U.S. since 2021, 41% of which involve children. Although delta-9 THC, the most intoxicating component of cannabis naturally occurs, manufacturers of hemp products often turn non-intoxicating CBD to intoxicating Delta-8 THC by using a synthetic chemical procedure.
Even though the Illinois Legislature adjourned their regular session of 2025, they can still pass laws during their fall “veto” session which runs from Oct. 14-30.
Pritzker said this week that, regardless of whether hemp-related bills are passed during the veto sessions, he is ready to regulate the unregulated THC market through his office.
If the Legislature or the supporters of the hemp industry refuse to take action, we will use executive measures, as this is not acceptable. “Now, the federal government actually is in a position to do this nationwide and should—hasn’t done it yet.”
Senate Appropriations Committee Unanimous approval Rand Paul, R.-Ky. resisted the prohibition clause in a bill to fund $27 billion, and was subsequently removed. The funding package is a great way to get started.
Eight U.S. Democratic Senators met earlier this week to discuss the issue. Party leaders are sent A regulatory framework based on four points:
- Restricting the sale and ownership of hemp to those aged 21 or over;
- Standardize packaging and labels to eliminate similar snack products appealing to kids while still allowing adults to make an informed choice;

- In order to guarantee safety, hemp-derived cannabinoid-containing products must be tested by independent laboratories.
The chances of John Thune R-S.D. as Senate majority leader caving in to demands from the minor party are low.
The debate focuses on the question of whether hemp-derived products can be regulated or prohibited. However, due to federal inaction many states are left to implement their own policy that is often reviewed by the courts in light of the Farm Bill 2018.
