Montana lawmakers passed a law allowing tribal nations, as well as the Governor’s office, to form compacts that would legalize and regulate marijuana on each reservation.
Montana’s legalization of cannabis created problems for tribal marijuana operations. These included limited licensing options, license types that were limited, and restrictions regarding where the tribes can establish their dispensaries. Frank Smith, a state representative (D), sponsored a bill to address tribal cannabis operations. The bill would allow tribal and state officials to negotiate tax issues, production limits, and other issues.
Patrick Yawakie, Red Medicine, LLC co-founder, told the reporter that tribal gaming contracts are similar to cannabis agreements.

House Bill 952, a proposal that was backed by the vast majority of Democrats and Republicans in the legislature, passed this past month.
The compact’s supporters say that it will allow reservations to use cannabis to reduce their use or to boost economic growth. However, opponents claim the change is not necessary.
