New York Cannabis Regulators messed up Dispensary location guidance; 152 stores affected

On July 28, the New York Office of Cannabis Management issued a correction regarding distances between schools and 105 licensed marijuana dispensaries, as well as at least 47 applicants who are still pending.

OCM has determined that it erred by approving the locations of these 152 retail outlets/aspiring retailer through the guidance the office set up in 2022. This included measuring the state entrance-to entry distance between a cannabis dispensary, and school. According to state law, dispensaries of cannabis must be no more than 500 feet from schools.

OCM acting executive director Felicia Reid notified the state regulators about 60 of the businesses that have already opened, and the remaining 45 are actively working towards opening their doors. OCM, Gov. Kathy Hochul’s office is “aggressively” working to find a solution that will allow licensed dispensaries with locations that are in violation of state law.  

According to the overview, “This legislation will allow licensees remain in their current licensed location.” The New York State Legislature has the right to pass or not the proposed legislation.

The OCM, in the absence of this legislative fix cannot renew the permits for the already licensed 105 retailers. According to OCM, until the licenses expire, the dispensaries may remain open.

The OCM wants to keep dispensaries open that have already been approved, but that decision is only up to state legislators.

In the meantime, OCM requires the 47 applicants affected by the mishap at the office to move on with their application before finding a new location.

The OCM is “easing the burden” on the OCM by working together with Hochul and Empire State Development in order to develop a relief program of $15 million. This will allow applicants to receive up to $250 000 each to assist them to find new premises or make improvements at their existing locations.

OCM states that the OCM will assist these applicants with provisional licences or extensions of current provisional licensing.
