Nobel is accused of possessing seven delta-9 pre-rolls and a vape pen containing hemp-derived THC, and is charged with possession of a controlled substance and second-degree possession of marijuana.
Athens, Tennessee is located about 10 miles from the Tennessee border where hemp-based products are still legal.
Mark McDaniel of WAFF, who does not represent Nobel, said that the arrest near the Tennessee border did not come as a shock.
Do not think you can just go up to Tennessee for a few days and come back with hemp, a vape, cigars, etc. When you bring the product back to your home, you may think that it is legal because it was purchased in Tennessee. Don’t matter.” — McDaniel to WAFF
The new Alabama law makes it a Class C felony to possess or sell smokable hemp products, including vapes, hemp flower, pre-rolls, and cigars. State law stipulates that a Class C felon is punished by prison terms of up to 10 year and fines as high as $15,000 for those who commit the crime.
