Petition to Trump: Remove Cannabis from Federal Drug Schedule

Drug Policy Alliance seeks signatures on a petition asking the Trump Administration to de-schedule marijuana under the Controlled Substances Act, rather than rescheduling to Schedule III. The Drug Policy Alliance says that descheduling is “the only way to end federal prohibition of marijuana.” 

In the petition, it is noted that Donald Trump (R), then a presidential candidate in 2024, said during his campaign he thought it was time for arrests and imprisonment for small amounts of cannabis. 

Anything less than de-scheduling is not enough because it continues to criminalize people who use marijuana. Everyday Americans will be at risk for being arrested, imprisoned, and burdened with criminal records which can lead to lifelong obstacles in housing, job, etc. This harm cannot be allowed to continue. “We hope you deschedule pot to bring federal cannabis criminalization an end and provide what Americans want and need.” — Drug Policy Alliance, in the petition 

According to this organization, declassifying cannabis under federal law completely would eliminate federal criminal penalties and would advance expungements of cannabis convictions. This would protect the public’s health and safety as well as consumer protection. Tax revenues from cannabis would then be used in local communities that were harmed by prohibition.    

Earlier this month, President Trump reportedly told donors during a dinner fundraiser at his private club in Bedminster, New Jersey that he is considering rescheduling cannabis from Schedule I to Schedule III under the CSA. During a press conference two weeks ago, Trump said the administration was “looking at reclassification” and would “make a determination over the next few weeks.” 

Former President Joe Biden’s (D) plan to reschedule marijuana under the CSA was initially pitched in May last year. However, the proposal was halted when Drug Enforcement Administration Administrative Law Judge John Mulrooney decided that the incoming Trump Administration would decide whether or not to restart the process. Mulrooney recently retired, leaving the issue solely with DEA Administrator Terrance Cole.
