According to Massachusetts Cannabis Control Commission, since the dispensary sale began in December 2018, the industry has generated over $8.3 billion dollars in retail revenues, almost $900 millions in excise and sales taxes, as well as nearly $540,000,000 in sales tax.

Massachusetts 2026 Legislature will consider a proposal once the signatures have been verified. Campbell’s Office says that if lawmakers do not act by May 6, 20,26, then the supporters will need to collect another 12,429 valid signatures before July 1, 2026 to be eligible for a proposed law in the November 2020 election.

Cunningham’s certified petition, Version A, aims to eliminate Massachusetts’ taxed, regulated, and adult-use cannabis market. It would also limit the potency of medical cannabis in Massachusetts, including placing a cap at 30% on flowers and 60% on concentrates. The petition would also ban concentrated forms of cannabis for medical use that don’t provide 5 milligrams THC per metered serving, with no more 20 100 milligram metered dosages in a package.

The “Version B”, however, does not contain these requirements. Both versions maintain the state’s medicinal cannabis program, and they are identical.

In addition, the proposed law would decriminalize possession up to one ounce or five grams (concentrate) of cannabis for anyone over 21. It would also allow adults to gift these amounts. Individuals who possess between one ounce and two ounces cannabis will be subject to civil penalties of $100, product forfeiture and mandatory community service. Those under 21 years old must also complete an education program on drug abuse and perform community services.

For those possessing less than 2 ounces, there would be certain protections, including access to financial aid such as student loans, financial support such as public housing, unemployment benefits or the right to drive or serve as an adoptive or foster parent. The use of cannabis would not bar a patient from getting a necessary medical procedure.

Primarily the petition will drive adults who use cannabis out of licensed, taxed and tested markets.
