California Emergency Hemp Regulations now Permanent

Gavin Newsom made the California emergency hemp regulations permanent.

The Governor Newsom approved emergency regulations in September of last year that required industrial hemp foods, food additives and beverages as well as dietary supplements to have zero detectable THC. Further, the products in question could not be purchased by anyone under 21. They could also only contain 5 servings.

California Department of Public Health adopted emergency rules pertaining to serving sizes and age restrictions that had been set to expire on March 31. California’s list for intoxicating cannabisoids did not require a readoption at this point, since it is in force until September 23rd 2024.

Last week, Governor Newsom signed Assembly Bill 8The state will regulate cannabinoid-containing products with trace amounts and those without, all under one regulatory framework.

AB 8 is a law that has several aspects. Among them, it ensures products containing intoxicating cannabis cannabinoids will only be sold by licensed dispensaries. The sale of other hemp products, such as cannabidiol(CBD), food and fiber items are legal.

We continue to put the safety and security of all Californians first.” said the Governor. “For too long, nefarious hemp manufacturers have been exploiting loopholes to make their intoxicating products easily available to our most vulnerable communities – that stops today.”

According to the Governor’s Office, the number of people who have complied with the (now permanent regulations) emergency regulation has been very high.

The Department of Alcoholic Beverage Control reports that its licensees have complied with the law to a level of 99.78% this year. Since September 2024 ABC agents visited 14,743 business and removed 7,210 products illegally from the shelves in 151 places.

Assembly Bill 8 has been authored by Assembly Minority Leader Cecilia Aguiar Curry.

With this bill we will have increased enforcement of the law, responsible regulation and help our legal cannabis business against illegal competition. said Aguiar-Curry.

California, the state that passed the Compassionate Use Act (1996) in 1996 was the very first US-state to permit medicinal cannabis. California voters legalized recreational cannabis use in 2016.
