When flying with cannabis, should you check your luggage or carry-on?

You can? You should? You may? You know the rules for flying cannabis?

Federal regulations still make cannabis illegal. It is therefore illegal to transport cannabis through federal checkpoints. You could be prosecuted if you are caught with anything. You may not be as afraid of the sky as you believe.

TSA: What is its role?

TSA’s (Transportation Security Agency), presence is intended to deter and stop threats against persons, properties, and Homeland security. The TSA is a busy agency, and they are under pressure to handle high traffic airports.

Their dogs and they focus their attention on weapons, explosives and drugs. If they suspect or have reasonable suspicion, they can stop you to search.

TSA agents do not make arrests. Airports belong to the local authorities or governments, so they’ll call the police in your area. Specifically, TSA.gov says,

Federal law prohibits the possession of cannabis and products infused with it, including CBD oil. TSA officers must report suspected law violations including the possession of marijuana or cannabis-infused product. TSA screening procedures focus on safety and are intended to detect threats to passengers and aviation. TSA agents do not conduct searches for marijuana, or any other illegal drug. TSA officers will still refer any substance they suspect to be cannabis or marijuana-infused products to law enforcement if it is found during a security check.

It does not matter whether you use a carry-on bag or a checked suitcase.

Local police: What is their role?

Rarely do local police prosecute or arrest passengers stopped by TSA. The police will often give you the option to destroy your stash if the passenger cooperates and is not under any influence.

In places where recreational and medical cannabis use is allowed, local authorities may let you carry up to the legal limit. You are willing to hand over a reasonable amount of cannabis if they do stop you.

Example:

  • In San Francisco it is common knowledge that the police will allow you to possess up to an ounce of medical cannabis. However, the police will only allow medical marijuana up to eight ounces.
  • You can fly from an Oregon airport to another Oregon Airport and still carry the maximum amount of luggage allowed by law.
  • Denver Airport will, on the contrary, require that you dispose of all your waste wherever you’re going.

The TSA will send you to the nearest police officer if they have reason to inspect your bag or yourself. According to the circumstances, the TSA may perform a simple search before recommending that you dispose of the product or place it in their lockbox. You may be arrested or denied boarding if they find you to be loud, aggressive or disrespectful.

The Baggage Checked

Checked bags are likely to be examined and opened. TSA agents have the right to open and x-ray your luggage, whether you are present or not. If they find anything suspicious, the TSA agents will remove it.

Prioritize all items that could be dangerous to the passengers and plane. They also look for drugs that have been smuggled, particularly when found in large quantities. They know how cannabis appears and the usual ways to conceal it. They may report the cannabis to police but if the amount is small, it’s just as likely that they will leave an indication of the fact the item was taken during the physical search.

Carry on Bags

Different airlines have slightly different size restrictions. Still, United Airlines defines “carry-on bag” saying, “The maximum dimensions for a carry-on bag are 9 inches x 14 inches x 22 inches (22 cm x 35 cm x 56 cm), including handles and wheels.”

This is the rectangle bag that you see everyone using at airports. It has a telescoping hand. Carry-on luggage is becoming more popular as the cost of checked baggage has increased. Some airlines now ban such bags from economy class.

Passengers are allowed to bring a personal item in addition to their bags. This is usually a bag, laptop or backpack for most people. If you have a laptop, then it will fit beneath the seat next to you. It measures 9″x10″x17″. Gate personnel may allow people to carry umbrellas, diaper bags, medical equipment and other items.

You can benefit from the increased security checks by bringing your carry-on bag. Everyone who has flown knows the rush and chaos of security. You shouldn’t have to worry about heavy security if you can keep it together and don’t look like a troublemaker.

  • It is not advisable to keep it in your pocket. Smoking on your way to the airport will make you smell.
  • The x-ray machine will scan your luggage, so make sure you pack it discreetly. Use medical bags or airtight containers to seal a small quantity of cannabis. You could also use smell-proof pouches and cases like those used for cigars.
  • Do not pack cannabis into any containers which will draw attention. This includes bottles, glass containers and other similar items.
  • With the chips or trail mix, place a few small pieces of your favorite product.

You can save money by purchasing items designed specifically for traveling. The majority of these items will pass the first inspection by appearing as toiletries, cosmetics, or medicines. It is important to keep odors out of the container.

Cannabis and flying

You can? You should? Can you? You can carry cannabis on your luggage. Every day, millions of people do this. You do it at your own peril.

Do you need to? Save yourself some trouble if you plan to fly into an area where marijuana is legal. It is not a problem if you have enough for your entire trip. The higher the risk, however, the greater the amount of marijuana you have. Although you may want to carry your card for medical marijuana as a safety precaution, the TSA does not have an obligation to honour it.

Can you? No, you may not. Intercontinental and Interstate flights can take you into locations where marijuana is prohibited and punishable. In the United States, it is illegal to possess cannabis and pass through a federal checkpoint such as one in an airport.

Conclusion? Use your brain. If it helps reduce your stress, you can eat or drink an edible prior to the flight. Smoking is not allowed on any plane. You will need to prepare yourself to go up to 10 hour without smoking. It may become a serious problem if your day is not successful.
