Dallas, Texas pauses voter-approved cannabis decriminalization charter

A FOX 4 news report states that city officials have agreed to temporarily suspend the enforcement of the charter amendment decriminalizing cannabis in Dallas. The voters approved this amendment last November.

Dallas is among the many Texas cities that have adopted local decriminalization reforms. However, the city agreed to drop the voter-backed measure due to pressure from the state Attorney General Ken Paxton (R), who has sued the city — and other cities with similar local rules — for enacting policy that supersedes state law, under which cannabis remains strictly prohibited.

Dallas officials placed a hold on the charter approved by voters after the Austin appeals court overturned the law last month.

Eight Texas cities, among them Austin, Bastrop and Dallas have decriminalized cannabis locally. Denton City Council, however, voted to reverse the reforms approved by voters. San Antonia voters rejected the same reforms last year, as did Lubbock residents.

Dallas voters approved of the cannabis decriminalization charter local with 67% approval.

Russell Wilson, former assistant district attorney for Dallas County, believes that the decision will likely come from the Supreme Court of Texas.

Wilson stated in the report that “the city could argue it has a legal right to adopt the law the way it did.” The issue could be debated. This means, in the meantime until this issue is resolved, that the city cannot immediately begin enforcing law.
