Following a unanimous decision by the tribe’s tribal council, on Tuesday the Omaha Tribe of Nebraska has become the first Nebraskan government to legalize cannabis for both adult use and medical purposes.
Nebraska voters approved medical cannabis legalization in the state last November. But lawmakers have failed this year to pass legislation that implements the program.
John Cartier of the Omaha Tribe of Nebraska attorney general said, “The Omaha Tribe does not wait for broken systems to deliver.”

In the new law, a Cannabis Regulatory Commission is created to regulate tribal medical cannabis and adult use industries. Adults over 21 years old, as well as non-Tribal visitors on Reservation land, can participate in the program. Commission regulators will monitor the process of cannabis licensing, product testing, enforcement, etc.
A press release stated that the law would also “dispense with prior Tribal Cannabis offenses” and provide a framework of social equity in order to correct the damage caused by past criminalization.
Legalization took place immediately. The tribe plans to start its cannabis program in 2025 with licensing, compliance and public education.
After the Nebraska Legislature failed to act on a medical marijuana program approved by the voters, officials proposed emergency rules for medical cannabis, and the Governor approved them earlier this month.
