Adult-Use Cannabis Bill Filed in Texas  – MEDCAN24

A bill to legalize cannabis for adult use in Texas was filed last week by state Rep. Jessica González (D). This proposal was submitted during the special session that Gov. Abbott called. Greg Abbott (R), would legalize cannabis for adults 21-and-older, allowing the possession up to 2.5 ounces of flower in public – with 10 ounces allowed at home – and 15 grams of concentrates. This measure does not allow home cultivation.  

The Texas Department of Licensing and Regulation would have the responsibility of regulating cannabis production and sale, as well as issuing licenses to cultivators, testers, processing facilities, retailers, and processors. By November 1, 2020, licensing would be implemented.     

This bill includes provisions for packaging that is child resistant and prohibits packaging of edibles, cannabis products or other products from looking like commercial candies. It includes tracking rules from seed to sale, as well as regulations on security at facilities, pesticides, and marketing.  

According to this legislation, the Texas Department of Safety would oversee the laboratory tests and the Texas Department of Safety will receive 10% of all cannabis revenues. The remaining 20% of revenue generated by localities that have at least one license for cannabis is distributed to them. The remainder of the funds will be given to Texas Education Agency Foundation School Program. 

This measure is yet to be assigned a legislative committee.
