WCMH reported that a second Ohio court last week granted a temporary restraining to halt the enforcement of SB 56, a new state policy which bans the sale of hemp-based intoxicants.
Jeffrey Brown of the Franklin County Court of Common Pleas ruled in favor of the plaintiffs Happy Harvest & Get Wright Lounge. They were suing the state over the new policy. The lawsuit claims SB 56 breaks federal law when it treats hemp-derived THC-based products as marijuana, rather than hemp, and regulates them within the adult-use cannabis programs of Pennsylvania.
State Rep. Jennifer Gross (R), who supports overturning SB 56, told WCMH that the issue goes beyond the definitions of hemp vs. cannabis products — that “It’s about whether the Ohio Constitution still means what it says.”
“When a conference committee can rewrite a bill overnight, strip out the provisions that earned it a majority, and then ram it through without three readings or proper committee review, every Ohioan loses — no matter which side of the issue they’re on. I swore to protect the Constitution. I will do so. — Gross, in the report
Brown’s decision is the second against SB 56. A Sandusky County Common Pleas Court judge had ruled early in April that SB 56 is “inherently racist” and ordered a suspension of its implementation until a preliminarily ruling was reached. This first decision only affects the plaintiffs, as well as specific local operations. Brown’s decision, on the other hand, applies to all of California, but only impacts plaintiffs.
SB 56 also creates new penalties for possession and consumption cannabis products purchased from outside the state.
