Republican Attorneys general sue to block Trump’s Cannabis Rescheduling Order

Nebraska Examiner: Last week, state attorneys from Nebraska and Indiana filed suit against the Department of Justice for its recent decision to reschedule cannabis as a medical drug.

All Republicans, including the Nebraska AG Mike Hilgers and the Louisiana AG Liz Murrill as well as the Indiana AG Todd Rokita argue that the move to reschedule will allow for easier implementation of adult-use policies. This suit is also against expanded medical cannabis cultivation and changes to tax laws under the federal new regime.

AG Hilgers was opposed to the Nebraska Medical Cannabis Legalization Campaign in 2024. However, about seven in ten voters approved of the reforms. Hilgers will face Democrat Jocelyn Brasher in the upcoming election. Brasher is a former Nebraska Assistant Attorney General.

Louisiana lawmakers have established a medical cannabis program for those with debilitating illnesses. In Indiana, however, marijuana is illegal for all purposes.

Last December, Trump also issued an Executive Order calling for cannabis to be rescheduled from Schedule I into Schedule III of the Controlled Substances Act. Last month, the Department of Justice released a second order that officially reclassified state-regulated cannabis products as Schedule III. However, the latest order does not apply to other cannabis forms, which means that state-licensed operators for adult use are still in violation of federal law.

The DEA has scheduled hearings for the purpose of evaluating a complete rescheduling for cannabis, out of Schedule I. Schedule I should be reserved only for drugs that have “no current accepted medical use” and a very high abuse potential.
