Arizona Repeal Bill targeting Recreational Cannabis Adopted Amid Changing Policy Landscape

Early May saw the abandonment of an effort spearheaded by American Encore to repeal Arizona’s recreational marijuana law. It is an important development. Arizona cannabis policyThis reflects a new assessment by the primary promoter.

Evolution of the Repeal Initiative

Sean Noble of American Encore who is the co-founder of Arizona Repeal Marijuana legalization initiative, originally sought to reduce recreational marijuana sales and preserve the state’s existing medical marijuana programs. Sein stated concern was centered around perceived risks to children. He believed that recreational marijuana allowed for improper marketing practices.

Noble’s opinion has been revised since then on the potential dangers of legal cannabis to children. He attributed the change in his opinion to the changing political climate surrounding cannabis, and the reevaluation available research. Noble acknowledged he had been misinformed about specific marketing practices used in Arizona.

The things I had thought that they did have not been done. Noble said, “I don’t believe they are marketing candies and gummies the way I thought they would be.” Maybe they do that in other States. “But it doesn’t happen here in Arizona.”

In Arizona, it has been illegal for cannabis brands to create products, strains names and packaging appealing to children. For example, strains such as Skittles or Girl Scout Cookies are sold under the abbreviations ZKZ and GSC. A few years ago, Californian brand Jeeter had to change the branding of its cartridges because they looked like juice boxes in Arizona.

Federal Rescheduling Framework and State Regulatory Frameworks

Noble stated that the recent federal classification of medical marijuana as Schedule III drug is a factor in the wider cannabis political scene. Noble’s initiative was not aimed at medicinal cannabis. However, the federal decision has contributed to a more valid framework for cannabis medical benefits, which is applicable to Arizona.

Arizona’s cannabis policies were further shaped by the passage of House Bill 2179 in early 2018. The legislation aims to expand existing restrictions regarding cannabis product and advertising design.

Arizona has Enhanced restrictions on cannabis advertising

  • Imitated Products It is illegal for marijuana products to imitate or appear similar to brands that children are familiar with.
  • Ban on images: On July 1, cannabis products will no longer be able to feature Santa Claus or other animated characters.
  • Advertisement Placement It prohibits the advertising of marijuana products on shuttles, buses and trains. The law also prohibits the use of billboards in close proximity to child-care centers, churches and recovery centers as well as parks, K-12 schools, and other public places.

This ongoing effort is reflected in the regulatory changes made to reduce youth exposure to marijuana products. Arizona’s recreational marijuana program continues to operate, despite the abandonment of the repeal initiative.
