Bloomberg Law reported that four Massachusetts cannabis producers have challenged the ballot measure to end the adult-use market in the state this November.
The suit, filed in Supreme Judicial Court on Wednesday, asserts that the ballot measures violates the constitution of the state by merging multiple issues into one ballot question, and for failing to provide a “unified statement of policy” to the voters.
This ballot measure was titled, “Act to Restore Sensible Marijuana Policy.” It has been approved to appear on the ballot this year despite claims that it used fraudulent methods to gather signatures, including bait and switch tactics.
In the lawsuit, Attorney General Andrea Campbell as well as Secretary of State William Galvin are named defendants. They were responsible for allowing this petition to proceed. The lawsuit asks “that this Court quash Attorney General Andrea Campbell’s certification and enjoin Secretary of Commonwealth to place the Petition for the general election of 2026.”
If the initiative is approved, it will repeal state provisions on home cultivation and adult-use marijuana sales. The initiative instead contains language that decriminalizes the possession up to 2 ounces cannabis.
In a poll conducted last month, only 20% of Massachusetts residents supported the elimination of Massachusetts’ adult-use industry.
