Nebraska Cannabis Program Emergency Regulations are Approved

Last week, the Nebraska Medical Cannabis Commission approved emergency regulations to implement the long-awaited state program. The Governor must now sign off on the new rules.

One dispensary is allowed in each of 12 district courts of California, no matter the size of its population. Also, dispensaries and cultivators cannot be placed within 1,000 feet or less of hospitals, schools, daycares, churches and other public institutions.

It’s all about the timing. The Medical Cannabis Commission is required to establish, no later than July 1st 2025, criteria for approving or rejecting applications. This includes adopting, promulgating and enforcing rules and regulations that are reasonable and effective.

State law, however, requires that a 30-day notice be given before any public hearings on guidelines are held. This would have made it impossible for the Commission’s July 1 deadline to be met.

A letter sent to Jim Pillen by the chair of the Commission, Dr. Monica Oldenburg, reportedly stated that Nebraskans will seek out medical cannabis and similar products “from unregulated sources which could be harmful.” The Governor is expected to make a decision on July 1st.

The emergency regulations can last for 90 calendars days but they can be renewed a second time for another 90 calendars days.

Other news: Late last week, a district court judge in a county dismissed a suit against two state medical marijuana initiatives. The lawsuit claimed that the measures violated state and federal laws.

The Executive Director of Nebraskans for Medical Marijuana, NMM (Nebraskans for Medical Marijuana), commented on the lawsuit’s defeat. Crista Eggers said:

This is yet another attempt that has failed to remove the will of people. It should be a message sent to the opposition to let them know they’ve lost.
