In a letter to President Donald Trump (R) and his pardon czar Alice Marie Johnson, 28 Democratic lawmakers, along with independent Bernie Sanders (VT), are seeking the administration to pardon everyone in federal prison for non-violent cannabis crimes.
The letter notes that the administration’s decision to move cannabis from Schedule I under the Controlled Substances Act to Schedule III “does not provide relief for anyone currently in federal prison from a marijuana conviction.” The letter notes that data from the U.S. Sentencing Commission estimates that there are about 3,000 people federally incarcerated for cannabis trafficking offenses, and another hundreds or thousands serving mandatory minimum sentences of five years or longer.
The arrest rate of African Americans is also 3.6 times higher for marijuana possession than that of whites, even though their usage rates are similar. Many people serve far too much time for marijuana related offenses. It means that families and loved ones are separated from each other for many years and even decades due to the antiquated marijuana laws in our country. “Thousands of people are still federally imprisoned for marijuana-related crimes, despite the fact that many states in some form have legalized this activity.” — Letter to Trump and Johnson, 5/22/26
In the letter, it is also stated that releasing federal prisoner would ease overcrowding at the Bureau of Prisons.
The letter says that “while it won’t fix the structural problems that led us to this point, we believe commuting sentences for people who have committed marijuana crimes would address overly harsh penalties while simultaneously allowing BOP resources where they are most needed,”
The letter was led by Reps. Steve Cohen (TN) and Steven Horsford (NV), and Sen. Cory Booker (NJ).
