Alabama Court vanes more Medical Cannabis license restraining orders – MEDCAN24

The Alabama Court of Civil Appeals canceled four temporary restraining and other orders relating to the Alabama Medical Cannabis Commission last week. News of 1819 reports. According to the order, Montgomery County Circuit Court Judge James Anderson is instructed to revoke the restraining measures against the agency in relation to three applicants for integrated facility licenses and one applicant for dispensary. 

In a statement, AMCC Director John McMillan said officials “are pleased” that the court “has once again affirmed that investigative hearings and not lawsuits are the next right step in implementing Alabama’s medical cannabis program.”

Court of Civil Appeals decision follows a similar decision The court had ruled about two weeks earlier that the Circuit Court lacked jurisdiction to hear the cases that resulted in the temporary restraining order because the administrative process of the AMCC isn’t final. 

Both rulings are consistent with the AMCC’s position that its license award decisions are not final until the statutorily required investigative hearing process is completed.  

Alabama legislators first approved the reforms of medical cannabis in 2021. The process, however, has been plagued with lawsuits ever since the initial industry licenses have been awarded in 2023.  

AMCC chairman Rex Vaughn stated that the decision gives “hope to the suffering patients of Alabama who can finally reap the benefits from medical cannabis products.”
