Arizona Attorney general says ALL THC must be sold at dispensaries – MEDCAN24



Arizona Attorney general Kris Mayes informed retailers that hemp and all THC-containing products, as well as other products, must only be sold at licensed dispensaries. Arizona, like many other states has seen an increase of stores that sell delta-8 THC and hemp-synthesized products.

According to the AG’s Letter,

The Smart and Safe Arizona Act does not allow for the licensing of “marijuana businesses” but these businesses claim that they are allowed to sell THC-infused items under AGO Opinion Number I24-005 and the Federal Farm Bill of 2018. I24-005 (March 11, 2024). Arizona laws can be more restrictive even if the Farm Bill of 2018 allows such products.

Retailers may have some questions about the Farm Bill or the legality for such products. Retailers must stop selling products by April 24th or risk felony charges. The state will then begin to enforce civil and criminal penalties on unlicensed companies that sell edibles infused with THC. This letter also informed Sheriffs, Chiefs of Police, and County Attorneys that they can enforce criminal and civil penalties as appropriate.

On board dispensaries

Arizona Dispensaries Association said that it would alert businesses and consumers about the Arizona Attorney General’s Office notice, reinforcing the fact that consumers can only purchase THC-containing products from licensed dispensaries in Arizona.

Ann Torrez said that this is a crucial step to ensure the safety and security of our families, communities, and customers. Arizona’s marijuana program is heavily regulated and consumer safety is a top priority for our industry.

The court’s decision made former enemies into allies, as the ADA stated that it would be working closely with Sheriff’s Offices, Police, and County Attorneys’ offices to support and spread compliance. Arizona will not allow THC to be sold outside licensed dispensaries. Torrez added that businesses and consumers need to understand the laws in order to avoid penalties.
