WBTV reported that Democratic legislators in North Carolina House filed on Monday a bill to legalize cannabis for adult use.
Under the name “Marijuana Legalization and Reinvestment Act”, the proposal allows people 21 and over to own, grow, purchase, and sell marijuana under the state’s law. This bill, should it pass, will impose an excise duty of 30% on all retail cannabis sales. Local municipalities can also add a 2% tax to their local cannabis industries. Fifty percent of the state’s cannabis tax revenue would be allocated to specific funds and research programs — including a new Community Reinvestment and Repair Fund and a cannabis social equity fund proposed in the bill — while the remaining 50% would go into the state’s General Fund.
The bill includes provisions that prohibit the use of marijuana in public and keep the cultivation of cannabis out of sight of public eyes, including on private property. Renters and managers of property would have the right to restrict cannabis smoking.
North Carolina still hasn’t enacted significant reforms on the cannabis front at state level. However, the Eastern Band of Cherokee Indians in Qualla Boundary Region voted 2023 for the legalization of adult-use marijuana. They opened later an adult-use retail outlet that sold cannabis products in Qualla to customers aged 21 years and over, regardless of where they lived.
A Meredith College survey conducted in February found that 71% of North Carolina voters supported legalizing access to medical marijuana, while only 23% opposed reforms, and 6% were uncertain.
In North Carolina, last year the Senate approved the legalization of medical cannabis but it was defeated in the House.
