California Senate proposal seeks to rein in online sales of illegal cannabinoids through setting new guidelines for cannabis marketplaces.
SB 378 would require online cannabis markets to include in their terms of service whether advertisements and business information of unlicensed cannabis operators were visible, and whether the marketplace verified licenses of sellers of cannabis or cannabis products visible on its marketplace. Platforms which do not check licenses would need to display warnings about potential risks related to buying from unlicensed sources before engaging with these sellers; the bill further stipulated that online marketplaces allow individuals to report any illegal cannabis products listed for sale on its platform.
“Californians who voted in support of legalizing cannabis did not anticipate making available sketchy hemp products online for sale by anyone of any age,” according to state Sen. Scott Wiener (D), one of the co-sponsors.
Wiener asserts that illegal hemp and untested cannabis products are being sold alongside legal cannabis products on certain online marketplaces.
“The illicit sale of hemp and cannabis products with high levels of THC or synthetic intoxicants threatens California’s legal cannabis market as well as public health and safety, undermining our efforts in California to regulate marijuana. One solution would be going after online platforms that allow illicit hemp sales without an age verification requirement or age verification requirements, helping legal cannabis businesses expand and improving Californians’ public health.” — Wiener stated in his press release.
United Food and Commercial Workers Union members in California favored California’s legal cannabis measure because of its rigorous testing requirements and consumer protection features, according to John Fram, president of UFCW Local 5.
“SB 378 will level the playing field between illicit cannabis businesses and legal businesses that has long been uneven by making sure marketplaces advertising illicit marijuana will be held liable and also intoxicating hemp will not be sold illegally.”
