Florida legislation would restrict hemp products – MEDCAN24

Florida lawmakers tried, during the last two legislative session to place significant restrictions on hemp. According to industry representatives, this could have had a devastating effect on their bottom lines. The measure passed in the spring of last year, but Governor. Ron DeSantis, a Republican governor from Florida, vetoed the measure in June.

Tracie Davis, a Duval County Democrat Senator (SB 10030), has filed a version for 2025. She proposes a series of restrictions on the hemp industry.

  • Put limits on the delta-9 levels of THC found in hemp products. They are limited to 2 mg per serving or 20 milligrams a container.
  • A ban on delta-8 THC products.
  • A ban on hemp extract products from being sold in a form for smoking—with a third violation resulting in the revocation of the violator’s license, permit, authorization, certificate or registration.
  • The sale of hemp-based products at gas stations is prohibited.
  • The ban of placing hemp shops within 500 feet from a daycare or school.
  • The advertising of hemp products in public places such as parks, streets, and sidewalks is prohibited.
  • Organisers of events cannot promote, advertise or host an event if hemp products from unapproved sources are used.
  • Law enforcement will randomly inspect hemp locations without prior notice.
  • It would prohibit the sale of hemp-based products to businesses that attract children.

Hilary Cassel of South Florida has introduced a proposal (HB601) to regulate hemp-based products in the Florida House.

Several hemp-industry members praised DeSantis’ veto of last year’s cannabis bill. They then helped finance efforts against the constitutional amendment that would have legalized recreational marijuana use on the ballot in November.
