On Tuesday, Idaho Senate members voted 27-8 in favour of passing legislation creating a mandatory minimum fine of $300 for simple marijuana possession, marking its approval. House of Representatives already gave its blessing in January at 54-14 vote.
House Bill 7 will now go before Gov. Brad Little (R), for final consideration and consideration as law. Once there, Little has three options; sign into law himself or allow its passage without his signature; or veto it altogether.
House Bill 7 was co-sponsored by Sen. Brandon Shippy (R) of New Plymouth and, if passed into law, would establish a mandatory minimum fine of $300 for those 18 or over who possess less than 3 ounces of marijuana–in addition to any additional penalties allowed by law.
Supporters of this bill believe it can serve to toughen Idaho’s policies on marijuana while distinguishing it from its neighboring states.
Idaho’s surrounding states allow recreational or medical cannabis use; Oregon, Washington, Nevada and Montana permit sales/possession, while Utah offers medical cannabis options.
“Marijuana use was illegal across all 50 states just a short while ago,” Shippy stated. “Despite legalization efforts by each individual state, none have become better places for families or residents.”
Some critics of the bill argued against creating a mandatory minimum fine, claiming it removes discretion that judges and prosecutors exercise when dealing with cases individually.
House Bill 606, introduced last year but ultimately rejected, would have established a mandatory minimum fine of $420 for marijuana possession.
“Research studies suggest that fines do not always deter behavior, and legislation was introduced earlier that set a fine of $420 but failed. Now the fine is $300,” stated Senate Minority Leader Melissa Wintrow (D-Boise). “So I question where our fines should be set arbitrarily.”
