Illinois Senate Considers Bill to Prevent Vehicle Searches based on Cannabis Odor

Illinois Senate considering legislation Bill To prevent the police from stopping a car because of an odor like raw or smoked cannabis, if the driver has attained the age of 21, WREX 13, reports. This bill also eliminates provisions in the adult-use marijuana law of California that mandate cannabis be carried in an odorproof container in vehicles.  

This proposal is almost three months old. ruled that the odor of raw cannabis is legal grounds for a vehicle search – a Decisionmakers which runs counter to a decision In September last year, the court ruled that the smell of burned cannabis was not a legal basis for a search. 

According to WREX, state senator Rachel Ventura(D), who is one of bill’s sponsors, these two decisions would cause confusion for the police and the court.  

“… The smell of hemp smells the same as raw cannabis and so they’re now asking law enforcement the difference between hemp and raw cannabis in order to not violate someone’s fourth amendment right.” — Ventura to WREX 

This bill has been cleared by the Senate Criminal Law Committee. The House passed a previous version of this bill last year.
