The Supreme Court of Justice of Mexico (SCJN), in a landmark decision issued this week, ruled that cannabis consumers over the age of 18 are allowed to create edibles infused with cannabis for personal use. The ruling does exclude the making of cannabis edibles to be sold.
The Supreme Court of Mexico has ruled, “Individual cannabis consumption is permitted to include the preparation and consumption of cannabis-infused food for personal use.” The decision clarifies existing cannabis regulations, while maintaining restrictions on commercialization and distribution of these products. reported Mexico Business News In its local coverage.
“By a final vote of seven votes to two, the SCJN ordered the Federal Commission for the Protection Against Sanitary Risks to allow the preparation of marijuana exclusively in prepared or semi-prepared food intended for solely personal consumption.” The outlet also added. “The Court found incorporating cannabis into foods intended exclusively for individual consumption constitutes a normal culinary activity and doesn’t amount to manufacturing a food subject to a special sanitary regime.”
2018 Mexico’s Supreme Court ruled Cannabis prohibition for adult personal use is unconstitutional. The ruling was widely celebrated at the time. The Court initially set a deadline for lawmakers to complete the implementation of its decision. A one-year extension was granted to lawmakers after they requested it.
Mexico’s legislators requested another deadline due to the COVID pandemic. Another deadline was set. Mexico’s legislators have yet to adopt comprehensive reforms, including reforms that would allow adult-use marijuana commerce.
Mexico was the top source of cannabis smuggled in to the United States for decades. The legalization of cannabis at the state level in the United States, however, has led to a significant decrease in cannabis being smuggled from Mexico into the United States. Cannabis seizures at the U.S./Mexico borders had decreased by 98% since previous decades.
Legislators in Uruguay, Canada and other countries have adopted national adult-use cannabis legislation. In other countries, such as Mexico, court decisions have given adult cannabis users some protections. However, these were not approved by national legislators.
