Rastas and the Law: A Pivotal Round Table to End Cannabis Arrests

The South African Human Rights Commission (SAHRC) hosted a groundbreaking Rasta Round Table on 26 February 2025 at the Birchwood Hotel on the East Rand. This historic meeting brought together Rastafarian representatives from all nine provinces and senior security officials. The primary goal? To end cannabis-related arrests and address broader issues of discrimination against the Rastafari community.

A Step Towards Equality: Recognizing Rasta Rights

The SAHRC has identified the Rastafari community as an ‘Equality Focal Area’ (EFA), highlighting the need for special legal considerations. According to an internal ‘Concept Document’ drafted in January 2025, this designation aims to halt unjust cannabis arrests and tackle systemic discrimination against Rastas in South Africa.

Funding the Dialogue: The R250,000 Rasta Round Table Budget

The leaked Concept Document, signed by Commissioner Tshepo Madlingozi on 3 February 2025, allocated R250,000 to the event, primarily covering travel expenses for delegates. Around 45 participants were invited, including Rastafarian community members, experts, and government representatives. While the SAHRC covered travel and accommodation for Rasta attendees, state officials were expected to fund their own participation.

This meeting follows a previous discussion between the SAHRC and the Justice Department on 29 January 2025, where government officials confirmed their attendance at the Round Table.

Addressing Ongoing Discrimination

The SAHRC has strongly condemned the continued search and arrest of Rastafari individuals, often based solely on their distinctive appearance. These actions, the Commission argues, not only discriminate against Rastas but also criminalize their faith. Many reported experiencing dignity violations during police searches, particularly when conducted in front of their children.

Other pressing concerns raised by the Rastafari community include:

  • Religious Expression in Schools: Schools banning children’s dreadlocks, forcing families to choose between education and faith.
  • Limited Dietary Consideration: Public institutions, such as hospitals and correctional facilities, failing to accommodate Rastafari dietary needs.
  • Marriage Recognition: The state does not currently acknowledge Rastafari wedding ceremonies as legally valid marriages.
  • Barriers to Employment: Many Rastas face job exclusion due to past cannabis-related convictions.
  • Obstacles to Legal Cannabis Trade: High costs and bureaucratic red tape make it difficult for Rastas to acquire licenses to cultivate and sell cannabis, despite their long-standing advocacy for its decriminalization.

Key Objectives of the Rasta Round Table

The SAHRC outlined several critical goals for the Round Table discussions:

  1. End Unlawful Arrests: Cease the arrest and prosecution of adults for private cannabis use and possession.
  2. Erase Criminal Records: Expunge the records of those convicted for past cannabis-related offenses.
  3. Legal Recognition of Rasta Marriages: Advocate for the Department of Home Affairs to recognize Rastafari wedding ceremonies.
  4. Fair Access to Cannabis Licensing: Remove barriers preventing Rastafari from obtaining cultivation and sales licenses.
  5. Full Cannabis Decriminalization: Open discussions on the complete decriminalization of all cannabis-related activities in South Africa.

The Rasta Round Table marks a significant step towards legal and social recognition of Rastafari rights. With the backing of the SAHRC, the community’s demands for fair treatment, religious freedom, and equal opportunities are gaining momentum. The outcome of this initiative could set a precedent for broader cannabis policy reform in South Africa, ensuring that Rastas are no longer treated as second-class citizens in their own country.
