KXAN reported that the Texas House State Affairs Committee approved a Senate-approved THC ban last week by a vote of 15-0. The panel amended the proposal, though, to establish a regulatory structure for edibles derived from hemp, beverages and products containing low doses of flower.
The bill, which passed the Senate in March, originally called for banning products that contain any amount of THC, including products legally classified as hemp. The House amended version, however, would limit the sale of hemp products to adult consumers aged 21 or older.
This bill would also outline product testing requirements, a fee structure and put Texas Alcoholic Beverage Commission (TABC) in charge of hemp products regulations. The THC-vaporizers would remain banned. A summary of changes stated that other products are allowed “as they do not look like a snack commonly marketed for children”.
Report: Retail stores would have to be at least 1000 feet from any schools, churches or daycare facilities, as well as playgrounds. County councils could “opt out” by local voting of the hemp rules.
Texas Lt. Governor Dan Patrick (R), who was elected as the Republican candidate for Texas Lieutenant Governor in late 2018, said that he would prioritize the ban on THC sales within the state during the current legislative session.
In the meantime, hemp advocates held a demonstration last month in the Texas State Capitol Building to protest the Legislature’s attempts to ban THC.
