Trump’s Nominee for DEA Leader Won’t Commit Schedule III Cannabis

President Donald Trump’s (R) pick to lead the federal Drug Enforcement Administration (DEA), said during a Senate confirmation hearing this week that if confirmed to the role, the cannabis rescheduling process would be one of his top priorities — but he refused to commit to moving cannabis to Schedule III despite a recommendation by federal health officials, Marijuana Moment reports.

Terrance Cole is a 22-year-old former DEA Agent who currently serves as the Virginia Secretary for Public Safety. President Trump has chosen him to become the next Administrator of the DEA. Cole was asked about his position regarding cannabis rescheduling during his Senate Judiciary Committee confirmation hearing this week by California Senator Alex Padilla.

What is the best way to get more information? [agencies] Cole stated that it is important to understand the scientific process and the expertise involved.

When I join DEA, the first thing I’d do is to check where we were in the administrative process. I’m not familiar exactly where we are, but I know the process has been delayed numerous times — and it’s time to move forward.” — Cole, during the confirmation hearing

Cole’s position was questioned by Padilla during the hearing.

Cole replied, “I will study everything done to date so that I can come up with a decision.”

Under the Biden Administration in 2023, the Department of Health and Human Services (DHHS) recommended that cannabis be moved from Schedule I under federal Controlled Substances Act to Schedule III. However, after nearly two years, the effort has stalled with many pointing to the DEA — which was tasked with overseeing the move — as having purposely dragged its feet on reforms.

John Mulrooney, DEA Administrative Law judge, cancelled a much-anticipated rescheduling in January because of improper communication between DEA officials. The judge stated since that the next agency administrator would decide whether or not the hearing is rescheduled.
