Federal Bill Would Regulate Intoxicating Hemp Products Like Alcohol

The proposal includes a three tier distribution system that covers product labeling and advertising as well as trade practices rules. It is modeled on the alcohol regulations. The bill also sets the minimum age to purchase or consume hemp products at 21, and requires product testing for the industry. The federal excise taxes would be 8 cents for each milligram intoxicating THC contained in each beverage.

Federal law will prohibit the sale of THC derived from hemp in December.

Van Duyne, a North Texas Representative, said that he had heard from consumers and sellers of hemp-derived drinks that they needed clarity. They did not want a ban, which would push this market underground.

The Beverage Regulatory Parity Act provides the industry with long-overdue assurance by regulating beverages using the same structure that has been used to regulate alcohol for decades. I am pleased to introduce this bipartisan bill with Rep. Greg Landsman because American families and businesses deserve sensible regulations and structure that protects children and allows adults to choose the beverages they prefer. — Van Duyne, in a press release

Rep. Landsman said, “People in Southwest Ohio have made significant investments in these products and done so in a safe manner.” “Now, the federal government tells them that they can no longer sell these products. Our bill has bipartisan support and is very simple. “It will keep people safer and allow these people to stay in business.”
