Florida Senate Votes Unimally to Restriction Hemp Derived THC – MEDCAN24

The Florida Phoenix reported that lawmakers in Florida’s Senate voted this week unanimously for a bill to prohibit hemp-derived products containing delta-8 THC and severely restrict products containing delta-9 THC.

SB 438 limits the amount of Delta-9 THC that can be found in edible hemp products. This is limited to 5 milligrams for each serving, and 50 milligrams on containers. THC-infused hemp drinks, on the other hand, will be restricted to five milligrams in each container. They can only be sold at locations with a license for liquor.

In order to protect children from THC exposure, the proposal would also require third-party testing for all hemp THC products sold in the state. The bill would also ban advertising of hemp THC products as well as implement stricter marketing restrictions.

State lawmakers approved a similar bill last year — also with unanimous Senate support — but Florida Gov. Ron DeSantis refused to approve the bill. However, the governor’s veto is a calculated move, because many in the hemp sector joined the fight to stop the legalization of cannabis amendment. The measure failed, with 56% support from voters.

Florida state senator Tracie (D) Davis (as a sponsor of SB 438) acknowledged that the proposal was similar to what she had proposed last year in her final remarks. She said that “this was a bill which was voted” and that “there is not much difference between last year’s proposal.”
