Marijuana Moment reported that Republican members of the House Appropriations Committee have proposed a provision in a budget bill which would prohibit the Justice Department to allocate any money towards efforts to reschedule marijuana under federal law.

This is the second time in a year that GOP legislators have included this provision in the budget bill for federal Commerce, Justice, Science, and Related Agencies. This effort is directly in opposition to the federal rescheduling that was officially launched by the Biden Administration 2024 and supported vocally by President Trump during his second campaign.

A DEA judge canceled a much-anticipated expert hearing on this issue, and the rescheduling may be permanently stalled under the second Trump administration. Unnamed White House officials said in April that there was “no plan” for the update of cannabis policies.

“SEC. 607. The funds made available or appropriated by this Act cannot be used to redistribute marijuana, as defined in the Controlled Substances Act section 102 (21 U.S.C. This Act prohibits the use of any funds that are appropriated, or made otherwise available to this Act for the purpose of rescheduling marijuana (as defined by section 102 in the Controlled Substances Act. 812).” — Excerpt of the spending bill

The spending bill includes a provision which has been in place for many years to protect state-legal programs that use medical cannabis from federal interference. This latest version would, however, increase the penalties for distribution of cannabis in close proximity to schools, colleges or playgrounds.

The Senate Appropriations Committee has proposed that the federal government bans the sale nationwide of products containing intoxicating cannabis after a period of one year.
