Mississippi Indian Tribe Plans Hearings Before Vote to Legalize Marijuana in Its Territory Next month

A Mississippi Indian tribe has organized a series public hearings to prepare for the referendum that will be held next month on whether or not marijuana should be legalized in its territory.

Officials with the Mississippi Band of Choctaw Indians are holding hearings between May 12 and 28 to gather public feedback.

On their ballots on June 10, tribal members are asked: “Do you support a Tribe that develops legislation to decriminalize, regulate, and control the possession, production and distribution of cannabis on Tribal land?”

The tribe would be the sole source in Mississippi for legal cannabis used by adults if tribal officials were to implement such a program.

This is one of the latest examples of increased interest among certain Native American communities to enact reform within their borders—despite federal prohibition and, in cases like Mississippi, state law.

The Eastern Band of Cherokee Indians in North Carolina approved the legalization of cannabis for adult and medical use by 2023. Sales began last year.

The policy has attracted the attention of congressional members, including Senator Thom Tillis from North Carolina who asked this week that President Donald Trump’s nominee for the Drug Enforcement Administration Director (DEA), investigate the legal implications.

Montana legalized marijuana statewide in 2020 through a voter initiative. The legislature passed a recent bill that allows the governor to sign compacts with Indian Tribes in order to eliminate barriers for their participation in this industry.

Minnesota has a similar system of compact agreements, which also allows cannabis for adults to use. Recently, an attempt was made to bring transparency into the process of that compact between tribes’ offices and the Governor’s Office.

It’s believed that in 2020, the Oglala Sioux Tribe, located in South Dakota, became the first tribe to vote to legalize marijuana within a U.S. state where the plant remained illegal.

Wisconsin’s indigenous leaders worked with each other to create a campaign, Wisconsin Wellness. Last year, the group held an event in support of medical marijuana at the Capitol.

In Mississippi, the use of medical marijuana was legalized by 2022 but adult-use marijuana is still prohibited.
