New Hampshire lawmakers move forward with plan to legalize simple possession of marijuana – MEDCAN24


The New Hampshire Senate and House committees acted on marijuana legislation on Wednesday. A plan was advanced that legalized the possession of cannabis by adults. Another proposal doubled existing limits on possession for caregivers, medical cannabis patients. The committees halted, however, broader legislation that would legalize and control a recreational commercial marijuana market.

The House Criminal Justice and Public Safety Committee approved two bills at a public hearing. One—HB 198, from Rep. Jared Sullivan (D)—takes a simple, unregulated approach to marijuana legalization.

If the measure is approved, adults over 21 can possess two ounces (60 grams) of marijuana flowers, up to 10 grams of cannabis concentrates, or up to 2,000 mg of THC per product.

Under the proposed plan, home-grown marijuana and retail sales of marijuana will remain illegal. Under the plan, marijuana consumption on public property would be banned.

Another bill—HB 190, from Rep. Heath Howard (D)—would increase the possession limit of medical marijuana by patients and caregivers, raising it to four ounces from the current two. The existing 10-day limits for patient purchases would be increased from 2 ounces to 4 ounces.

Members of the committee voted 9–7 in favor of HB 198 and 14–0 to advance HB 190.

New Hampshire lawmakers nearly passed legislation last session that would have legalized and regulated marijuana for adults—a proposal that then-Gov. Chris Sununu, a Republican politician from New Hampshire, had said he would support the proposal. Infighting about how to set up the market ultimately led to its demise. House Democrats narrowly voted to table it at the last minute, taking issue with the proposal’s state-controlled franchise model, which would have given the state unprecedented sway over retail stores and consumer prices.

In a separate vote, on Wednesday, the House Commerce and Consumer Affairs Committee unanimously voted to maintain an alternative bill of legalization from Sullivan. It was effectively placed on hold. This bill, HB 186 would allow adult users to possess cannabis and also control the market by licensing it.

Sullivan said that he hoped putting this bill on hold would enable lawmakers to revisit it in the second half of this year and make changes.

He added, “I strongly recommend that you do not plan anything for the first week in January.” “That’s a really exciting time because all of the bills in committees that have been retained will be brought to the floor during that week.”

Meanwhile, the full New Hampshire House has already passed a competing marijuana legalization bill—HB 75, from Rep. Kevin Verville (R). This proposal also removes penalties for adult cannabis use, however, unlike Sullivan’s bill it does not limit possession or cultivation. The bill would also exempt marijuana from state laws that prohibit illicit drug sales.

The registration cards of state-registered caregivers or patients could be revoked if the marijuana is sold to anyone outside the medical community.

The bill would still prohibit minors from using marijuana. Under 21s would commit a criminal offense if they were found to possess or use the substance. Anyone younger than 18 will be subjected to an assessment for addiction disorders. Cannabis use by adults in public is also a crime.

Recent legislation passed by the House allows medical marijuana patients at home to grow cannabis, and also annuls certain criminal records.

New Hampshire Governor Kelly Ayotte (R) is widely known to be opposed to any adult-use legalization bill that reaches her desk this session. Kelly Ayotte would, however, oppose adult-use legislation that might reach her desk during this legislative session. Ayotte is a former U.S. Senate and State attorney general who repeatedly said during the last election campaign that she will oppose any efforts towards adult-use legalization.

A poll from last June found that almost two thirds (65 percent) of New Hampshire residents supported legalizing marijuana. In June, 61 percent of respondents said they supported HB 1633, the legalization measure that failed in last year’s session.
