New York Regulator Issues 74 New Licences, Establishes New Trade Practice Bureau to Combat Illicit Market – MEDCAN24

New York’s Cannabis Control Board has granted another 74 retail marijuana licenses despite mounting legal action which had temporarily delayed this progress.
At its recent meeting held Friday, February 14, the regulator granted subpoena powers to the Office for Cannabis Management (OCM), while simultaneously creating a Trade Practice Bureau to combat unlicensed sellers.
Controversially, a Public Convenience and Advantage (PCA) proposal was advanced with an aim of amending existing zoning restrictions that limit how close dispensaries may be located from one another.
Of the 74 new adult-use retail licenses issued last week, 39 went to processors; 16 to retailers; 10 to microbusinesses; 6 for distributors and 3 were conditional retailers.
OCM reports that, to date, California has issued over 240 conditional adult-use retail dispensary (CAURD) licensees; another 300 licensees continue their search for suitable locations for CAURD stores.

Due to an impossibly large backlog of applications pending approval, 2000 were reviewed from November’s queue and an additional 5000 are waiting approval in December’s.
The newly established Trade Practice Bureau will focus on investigating predatory lending, licence stacking and product diversions within the industry.
Under this plan, PCA proposes to reduce minimum buffer zones between dispensaries in cities with over 20,000 residents from 1000 feet to 500 feet and from 2000 ft in smaller towns.
Businesses will also need to demonstrate an economic benefit before being approved as PCA participants, although waivers will be granted for hardship cases. It was controversial when this bill was first proposed but eventually managed to pass with only minimal changes needed for passage.
Now is the time for public input; expect heated remarks from critics warning about existing license holders already struggling against illegal operatorss during this 45-day comment period.

One week’s total adult-use retail license allocation included 39 processor licenses, 16 retailer licenses, 10 microbusiness licenses, six distributor licenses and three conditional retail licenses.
