KUT News reported that an appeals court in Austin, Texas on Thursday overturned the local decriminalization of cannabis policy.
Austin voters approved decriminalization in 2022. However, in 2024, Texas Attorney General Ken Paxton (R) sued the city — and other municipalities in the state with similar reforms — over the changes. A Travis County Judge initially dismissed the suit, but after Thursday’s ruling by an appeals court, it is likely to proceed.
Austin decriminalization laws had prevented police from investigating or prosecuting minor cannabis offenses. Austin’s Mayor Pro Tem Vanessa Fuentes, who plans to assess its next steps and evaluate the decision in the future, called it a “huge disappointment” according to the report.
Now, police officers will have to spend time on marijuana-related cases rather than violent crimes. The State has once again stepped on the local decisions made by Austinites. — Fuentes, in a statement
Austin, Dallas Denton Elgin Killeen and San Marcos are all Texas cities that have similar policies.
Catina Voellinger is the executive director of Ground Game Texas and helped to put the decriminalization ballot on the Austin and San Marcos municipal elections. She said, “These decisions do not change the fact the the people in Austin and San Marcos spoke in one voice.”
A poll conducted earlier in the year of Texas likely voters found that over 60% supported legalizing cannabis for adult use.
