Alabama’s Medical Cannabis Program is now set to advance after the Court of Civil Appeals of the state lifted a temporary restraining orders that had halted licensing. The Alabama Medical Cannabis Commission can now issue licenses for businesses that want to grow, process and distribute medical marijuana.
The Legal Dispute Background
Due to the legal challenges of applicants denied licenses, there were delays in the licensing process. Alabama Always filed a complaint alleging AMCC’s processes were flaws and lack transparency. As a result, the lower court issued an injunction, stopping the licensing procedure. The appeals court, however, determined that lower courts lacked jurisdiction and removed the injunction, allowing AMCC to continue.
Alabama Medical Cannabis Program Implications
The AMCC is now able to continue its efforts in establishing Alabama’s Medical Cannabis Industry. As businesses are now able to move ahead with their business, this development will likely expedite medical marijuana availability for qualifying patients. Next, the commission will finalize the licensing of businesses and supervise the implementation of the program in order to comply with the state’s regulations.
