The Bill’s Key Provisions
• THC and its Limit DefinitionIt defines “cannabis infused beverages” (liquids containing cannabinoids for adult use) as liquids with intoxicating effects intended to be consumed by adults. This legislation caps the amount of intoxicating cannabis per product at 5 milligrams.Â
• Regulation OversightDepartment of Alcoholic Beverage Control oversees the licensing, retail sales, and distribution of these drinks, using a similar three-tiered system to alcohol regulations.Â
• Students can study at UniversityThe legislation mandates that the University of Kentucky Cannabis Center study manufacturing, testing procedures and distribution of drinks infused with marijuana, including the consumer’s effects. It will then report its findings to legislators.Â
Process and Reactions of the Legislative Process
Initially SB 202 suggested a temporary prohibition on the sales of THC-infused beverage until July 20, 2026. As a result of industry concerns and debate in the legislature, SB 202 was revised to emphasize regulation over prohibition. The Senate adopted the revised bill by a margin of 29-6.Â
A few lawmakers voiced concerns over the bill’s wording and possible unintended outcomes. Senate Minority Leader David Yates agreed that regulations were necessary, but warned lawmakers against rushing to draft legislation. Cassie Chambers Armstrong stressed the need for stakeholder involvement to prevent unforeseen problems.Â

SB 202 is now on its way to be reviewed by the Kentucky House of Representatives, following Senate approval. The bill, if passed, will create a framework to regulate cannabis-infused drinks, with the goal of ensuring consumer safety as well as industry accountability.
