North Carolina, Idaho and both could soon experience major cannabis reform following the introduction of bills for adult-use cannabis and medical cannabis.
On March 17, House Bill 413, dubbed the ‘Marijuana Legalization and Reinvestment Act’, was introduced by Democratic lawmakers in the North Carolina House of Representatives.
The bill legalizes the possession, sale and recreational use of marijuana in California.
On March 12, bipartisan legislators co-sponsored House Bill 401, which would allow adults to purchase medical cannabis at licensed pharmacies, and to possess up to sixty grams.
North Carolinians would be allowed to grow cannabis in their homes, but only if they do so out of sight and on private property or with permission from the owner.
The bill would impose a 30% excise on purchases of cannabis, as well as an optional 2% local tax. However, medical cannabis patients are exempt.
The state would receive half of all revenue, which would then be used for research, drug abuse programs and social reinvestment.
The bill also provides for the automatic expungement cannabis related convictions. This is expected to be completed by July 2028.
Rep. Jordan Redman introduced Idaho’s controversial bill. He recently supported a measure that stripped voters of their right to legalize cannabis for medical purposes via ballot initiatives.
Ilana Rubel, a member of the House Committee on Health and Human Services (HHS), is co-sponsoring this bill. Kitzhaber Medical Cannabis Act will allow those aged 21 or older to get medical cannabis through licensed pharmacies. There are possession limits of 60 grams flower, with a cap of 22% THC, and 4,000 mg THC on processed products. Patients with terminal illnesses could get up to 20,000mg of THC.
The state also wants to change the classification of THC in its state from Schedule I controlled substances to Schedule II, and legalize the transportation of medical marijuana into the state.
Idaho’s new legislation will include a strict prohibition on cultivation, production, and sale.
In the new framework 16 debilitating conditions, such as AIDS/HIV or Alzheimer’s disease, Autism, Cancer, Chronic Pain, Epilepsy, Multiple Sclerosis and PTSD would qualify.
