CBS 42 reported that an Alabama court decision on Monday overturned December 2023’s issuing of licenses for medical cannabis by the Alabama Medical Cannabis Commission.
Alabama has tried to get a medical cannabis license multiple times. But legal challenges repeatedly have slowed down the process. Even though many operators had been operating for more than a year, they believed that they were in possession of a medical cannabis license.
The Circuit Court of Montgomery County has invalidated AMCC’s use of an “emergency” rule to proceed with licensing after the previous two attempts failed.
John McMillan (Director of AMCC) expressed his frustration in a WSFA Report.
The way things have evolved has made it pretty clear that Alabama has some powerful people who are trying to stop this program from starting unless the state follows their rules, which they seem to follow. “They’re attacking from every direction.” — McMillan, in the report
McMillan stated that the agency was weighing its options, and had not yet ruled out the possibility of appealing against the court decision invalidating the licenses.
